NOTICE is given of the death of Martha I. Drew, deceased. Letters of Office were issued on April 15, 2014, to Mary Kathryn Place, 2475 County Road 500 North, Homer, IL 61849.
Claims against the estate may be filed in the office of the Circuit Clerk, Champaign County Courthouse, Urbana, Illinois 61801, or with the personal representative, or both, on or before October 30, 2014. Any claim not filed on or before said date is barred. Copies of a claim filed with the Circuit Clerk must be mailed or delivered to the personal representatives and their attorney of record within ten (10) days after it is filed. Furthermore, the claimant shall file with the Court proof of any required mailing or delivery of copies.
Notice to Unknown Heirs - Will Admitted
A Petition For Probate And For Letters Testamentary has been filed in the captioned estate, alleging that the decedent’s heirs are unknown. Said Petition also alleges that the decedent’s estate has a value of approximately $482,065.00. An Order admitting the decedent’s Will to probate was entered by the Court on April 15, 2014. Copies of the Petition and Order are available at the law office of Miller, Tracy, Braun, Funk & Miller, Ltd., 316 S. Charter St., P.O. Box 80, Monticello, IL 61856, during regular business hours.
Within forty-two (42) days after the effective date of the original Order of admission, any heir or legatee may file a petition with the Court to require proof of the Will by testimony of the witnesses to the Will in open Court or other evidence, as provided in Section 6-21 of the Probate Act of 1975 (755 ILCS 5/6-21).
Interested persons also have the right, under Section 8-1 of the Probate Act of the 1975 (755 ILCS 5/8-1), to contest the validity of the Will by filing a Petition with the Court within six months after admission of the Will to probate.

Administration
Unknown Heirs, you are further notified that a copy of an Order granting independent administration of the decedent’s estate is available at the law office of Miller, Tracy, Braun, Funk & Miller, Ltd., 316 S. Charter St., P.O. Box 80, Monticello, IL 61856, during regular business hours. This means that the executor or administrator will not have to obtain court orders or file estate papers in court during probate. The estate will be administered without court supervision, unless an interested person asks the court to become involved.
Under Section 28-4 of the Probate Act (755 ILCS 5/28-4), any interested person may terminate independent administration at any time by mailing or delivering a petition to terminate to the Clerk of the Court. However, if there is a will which directs independent administration, independent administration will be terminated only if the Court finds there is good cause to require supervised administration; and if the petitioner is a creditor or non-residuary legatee, independent administration will be terminated only if the Court finds that termination is necessary to protect the petitioner’s request. A form of petition to terminate independent administration is available at the law office of Miller, Tracy, Braun, Funk & Miller, Ltd., 316 S. Charter St., P.O. Box 80, Monticello, IL 61856, during regular business hours.
In addition to the right to terminate independent administration, any interested person may petition the Court to hold a hearing and resolve any particular question that may arise during independent administration, even though supervised administration has not been requested (Probate Act Section 28-5, 755 ILCS 5/28-5). The independent representative must mail a copy of the estate inventory and final account to each interested person and must send notice to or obtain the approval of each interested person before the estate can be closed (Probate Act Section 28-6 and 28-11, 755 ILCS 5/28-6-11). Any interested person has the right to question or object to any item included in or omitted from an inventory or account or to insist on a full court accounting of all receipts and disbursements with prior notice, as required in supervised administration (Probate Act Section 28-11, 755 ILCS 5/28-11).
