In re: Application of the Village of Rantoul for Approval of the Extension or Alteration to Rantoul National Aviation Center – Frank Elliott Field.

On April 23, 2019, the Village of Rantoul filed an application for approval of an extension or alteration to the Rantoul National Aviation Center – Frank Elliott Field, owned and operated by the Village of Rantoul. The extension or alteration will consist of reconstructing and realigning Taxiway E at the west end of the intersection with Runway 9/27. The airport is located near Rantoul, in part of the Southwest ¼ of Section 1, the South ½ of Section 2, the East ½ of Section 10, Section 11, and the South ½ of Section 12, Township 21 North, Range 9 East of the Third Principal Meridian, Champaign County, Illinois.

On May 15, 2019, the Division served Notice of its intention to enter an Order approving said application, pursuant to Section 60 (620 ILCS 5/60) of the Illinois Aeronautics Act. No comments have been received by the Division on this matter.

IT IS, THEREFORE, ORDERED BY THE DIVISION OF AERONAUTICS AS FOLLOWS:

1. Unless the Division grants an extension of time for completion, this Order shall become null and void unless construction is satisfactorily completed within 18 months from the effective date hereof. If all requirements of the Division are met upon completion and final inspection, a Certificate of Approval for said Public-use Airport shall be issued to the Village of Rantoul. Applicant shall notify the Division within 30 days after the completion of construction.

2. Said Public-use Airport shall conform to all requirements (including written notice of abandonment) of this Division.

3. Unless the Department finds that a hearing is necessary or that a longer period is appropriate, this Order shall take effect twenty (20) days after the service date thereof.

4. This Order and Certificate of Approval create no private interest in the applicant or its successors. The Division expressly reserves the authority to revoke or modify said Certificate when in the public interest to do so.

5. This Order and any Certificate of Approval issued pursuant thereto do not pre-empt, waive, suspend or modify any zoning regulations, building code requirements, or local ordinance adopted by local governmental bodies.

6. The Certificate of Approval must be modified or reissued if any alteration or extension is made to the Public-use Airport.

An Environmental Review Record regarding the stated projects has been made by the above-named City of Champaign, which documents the environmental review of the project, and more fully sets forth the reasons why such statement is not required. This Environmental Review Record is on file at the above address and is available for public examination and copying, upon request, in the Neighborhood Services Department, 102 North Neil Street, Champaign, Illinois between the hours of 8:00 a.m. and 5:00 p.m.

David in her official capacity as City Manager, consent to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making, and action; and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval, the City of Champaign may use the CDBG funds, and HUD will have satisfied its responsibilities under the National Environmental Policy Act of 1969. HUD will accept an objection to its approval of the release of funds and acceptance of the certification only if it is on one of the following bases: (a) that the certification was not in fact executed by the chief executive officer or other officer of applicant approved by HUD; or (b) that applicant's environmental review record for the project indicates omission of a required decision, finding, or step applicable to the project in the environmental review process. Objections to the Release of Funds must be prepared and submitted in accordance with the required procedure (4 CFR Part 58), and may be addressed to HUD at Region V Office, Attn: Donald Kathan, CPD Director, 77 West Jackson Blvd., Chicago, Illinois 60604.
